LAS VEGAS, Nev. (July 21, 2026) The PSSA/PSBTA applaud today’s unanimous DC Circuit panel decision upholding the FCC’s 4.9 GHz decision.

As the court concluded, the 4.9 GHz Band is woefully underutilized, to the detriment of public safety.

The FCC’s Band Manager will help ensure that the 4.9 GHz Band is both better utilized and modernized for advanced technologies.

As the court made clear, the Spectrum Act authorizes FirstNet to utilize multiple spectrum bands to deliver innovative services to first responders, and the Band Manager can enter into a sharing agreement with FirstNet for use of the 4.9 GHz Band.

We look forward to the FCC beginning the Band Manager selection process and ensuring that the 4.9 GHz Band becomes a focal point for first responders’ use of advanced technologies.
